  • FEES AND PAYMENTS; SHIPPING

Prices. The price for Products available for purchase through the Site will be displayed to you on the Site. Any applicable taxes will be communicated to you before you place an order. There is no charge for standard shipping.

Payments. The Site currently uses third parties to process payments. Our third-party payment processors accept payments through various credit cards, debit cards and net banking as detailed on the applicable payment screen. You may also finance your purchase of Products through Affirm, as detailed on the payment screen.

REFUNDS AND RETURNS; CANCELLATION

Warranty

  • Cushion-pillow.com Product:

Your Cushion-pillow.com product is covered by different warranty periods. If there is an issue with your product, then please review the Warranty conditions here and please contact us at https://cushion-pillow.com/contact-us. The Product Warranty is incorporated by reference into these Terms. To the extent there is a conflict between the terms of the Product Warranty and these Terms, the terms of the Product Warranty will govern with respect to Products purchased from Cushion-pillow.com.

Returns

If you want to return any of the products that have a valid return policy in the first 10 days after your receipt of that particular product, then please follow the process detailed below for the product. Return shipping within India is free. You may cancel an order anytime prior to shipment.

  • Product Returns: If you want to return your Product within the first 10 days after your receipt, please contact us on https://cushion-pillow.com/contact-us  to arrange a return pick-up.
  • The following conditions also apply to Product returns
    • Products must be in donatable condition to be eligible for return (e.g., no stains, tears or other soiling including odors).
    • Products shipped outside of the India are not eligible for return.
    • Customers may return a maximum of two (2) of each particular Product per initial order, validated by a customer name or shipping address (i.e. please try a Product first—we are happy to send you more later!)
    • If at least one of a particular Product type is returned from an initial order, that customer or shipping address will not be eligible for additional warranty on subsequent orders of that particular Product.
  • Refund Mode and Duration:

Refunds will be made to the customer bank account details provided on official mail ID, within 10 working days of receiving the refund request.

  • Return Request Duration:

The return request can be placed at any time within 10 days of purchase. For all other warranty related claims, please see the warranty details mentioned here.

  • Title:

If your order is lost or damaged during the delivery process due to a fault of ours or of the logistics partner, we will employ our best efforts to work with you and the carrier to retrieve your shipment or to replace the damaged product.

  • Shipping:

When you place an order for Products through the Site, the Products will be shipped to the address you designate as the “Shipping Address” during the check-out process.

  • GIFT AND OFFER CODES;

From time to time, Cushion-pillow.com may offer qualified consumers “gift codes” or “offer codes” through a variety of promotional activities and communications (collectively referred to herein as “offer codes”) that are redeemable towards a purchase on Cushion-pillow.com.co, while supplies last, and subject to certain merchandise exclusions or any other restrictions as may be determined and communicated by Cushion-pillow.com in its sole discretion. Only valid offer codes provided or promoted by Cushion-pillow.com will be honored at checkout. Codes supplied or promoted by third parties unauthorized by Cushion-pillow.com (including any unauthorized third party websites) will not be considered valid. Each offer code promoted by Cushion-pillow.com is non-transferable and valid for single use on an item (or items) of merchandise as determined by Cushion-pillow.com. Offer codes cannot be used towards purchase of non-branded merchandise, packaging or applicable taxes. For online purchases, the code must be entered in the ‘offer code’ field at checkout. Offer codes are not valid for use by customers that elect to finance their purchase through Affirm. Offer codes are not valid in showrooms or stores and are valid online only. Cushion-pillow.com is not responsible for lost, stolen or corrupted codes or any unauthorized use of codes. Offer codes cannot be redeemed for cash or any cash equivalent; no substitutions or credits allowed. The dollar value of any offer code will not be refunded or credited back if any or all of the merchandise is returned. Expiry dates may apply to each offer code. Offer codes are void if copied, transferred, sold, exchanged or expired, and where prohibited. Requests not complying with all offer code requirements will not be honored.

Spokespeople. From time to time, Cushion-pillow.com may also engage spokespeople, influencers, bloggers, or other individuals or entities who have been compensated or incentivized to speak on behalf of the brand. When you receive an offer code via a third party source, such as a television or radio show host, please note that such individuals may have been compensated by Cushion-pillow.com for their statements.

We will provide notice to you promptly of any such claim, suit, or proceeding.

  1. DISPUTE RESOLUTION

These Terms and the relationship between you and Cushion-pillow.com will be governed by the laws of Gujarat, India without regard to its conflict of law provisions. You and Cushion-pillow.com agree to submit to the personal and exclusive arbitration of any disputes relating to your use of the Site under the rules of the Gujarat Arbitration Association. Any such arbitration, to the extent necessary, will be conducted in India in the State of Gujarat. You covenant not to sue Cushion-pillow.com in any other forum.

You also acknowledge and understand that, with respect to any dispute with the Released Parties arising out of or relating to your use of the Site, purchase of Products, or these Terms:

  • YOU ARE GIVING UP YOUR RIGHT TO HAVE A TRIAL BY JURY
  • YOU ARE GIVING UP YOUR RIGHT TO SERVE AS A REPRESENTATIVE, AS A PRIVATE ATTORNEY GENERAL, OR IN ANY OTHER REPRESENTATIVE CAPACITY, OR TO PARTICIPATE AS A MEMBER OF A CLASS OF CLAIMANTS, IN ANY LAWSUIT INVOLVING ANY SUCH DISPUTE; AND
  • YOU MUST FILE ANY CLAIM WITHIN 3 MONTHS AFTER SUCH CLAIM AROSE OR IT IS FOREVER BARRED.
  • TERMINATION

Upon termination, these Terms will still apply.

  1. ENTIRE AGREEMENT

These Terms constitute the entire agreement between the user and Cushion-pillow.com with respect to this Site and supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written with respect to this Site. A printed version of these Terms and of any notice given in electronic form will be admissible in judicial or administrative proceedings based upon or relating to these Terms to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. Any rights not expressly granted herein are reserved.

  • NO COST EMI OFFER

For the purpose of these terms and conditions, wherever the context so requires, “you” and “your” shall relate to any natural or legal person who has opted for payment in equated monthly installments (“EMI”) pursuant to payments made by credit cards (“EMI Offer”) for making any purchase(s) on Cushion-pillow.com.

By availing the EMI Offer, you are agreeing to and accept the terms and conditions set out herein:

  • The EMI Offer is being offered uniformly, on all the products listed on the Cushion-pillow.com Website. The EMI Offer does not amount to a waiver by any bank or financial institution on the interest component of the equated monthly installments being paid by you. However, this interest charge has been provided to you as an upfront discount at the time of your purchase, effectively giving you the benefit of a No Cost EMI
  • You agree and confirm that you will need to pay applicable EMI and interest on the total value of the order at the time of payment to the bank, in accordance with the terms applicable to the credit card through which you undertake the transaction.
  • The discretion to process payment lies with the bank that has issued the credit card being used by you for the transaction. Cushion-pillow.com will have no obligation or liability in the event the bank refuses to process the transaction, for any reason whatsoever
  • You agree that in the event you fail to make timely payments of EMI, there may be additional interests or penalties which may be levied by the bank, and you shall be solely liable to pay any such additional interests and penalties, if any
  • The EMI Offer is currently valid for EMIs having a tenure of 3 (three) months and 6 (six) months only. The EMI Offer is facilitated by selected banks only, as displayed on the No Cost EMI page
  • The minimum cart value to avail the EMI Offer payment option is INR 10,000 (Rupees Ten Thousand Only)
  • Any returns or cancellations will be as per Cushion-pillow.com’s returns and cancellation policy, available for viewing on the Website. In the event of any return of the product for which payment was made using the EMI Offer (“Purchased Product”), or refund of the amount paid by you pursuant to the EMI Offer in an EMI transaction, the interest already charged by the relevant bank will NOT be refundable.
  • Cushion-pillow.com will not charge a processing fee for availing the EMI Offer. However, the relevant bank may charge processing fees or cancellation charges as per their internal policies. Such charges shall be paid by you to the relevant bank and Cushion-pillow.com will have no liability or obligation to refund such charges in the event of return of the Purchased Product or cancellation of the orders placed on the Website
  • We request you to consult your bank or card issuer on the mechanics of cancellations, refunds or pre-closures affecting the terms of the EMI offered, and the details of the interest or cancellation charges that may be levied for the same
  • Cushion-pillow.com retains the right to modify or cancel these terms and conditions and the EMI Offer at its sole discretion at any time with no further notice
  • You understand and agree that there may be a constraint on the number of transactions or purchases on a specific credit card, based on the transaction limits set by the issuing bank. You confirm that you shall abide by the terms and conditions as may be applicable on the credit card being used by you.
  • You may be charged GST or other applicable taxes by your bank for the transactions undertaken using the credit cards issued by such bank
